BELLEFONTE, Pa. - One of the former Beta Theta Pi fraternity members charged in the death of pledge Timothy Piazza is taking his case to the state Superior Court.
Attorneys for Joseph Sala have appealed a Centre County judge's decision to allow another preliminary hearing in July to the Superior Court.
This is the first appeal to go above the Court of Common Pleas in Centre County.
Earlier this month, President Judge Pamela Ruest allowed prosecutors to refile charges against eight fraternity members, one being Sala. Those charges were previously dismissed in March by Judge Allen Sinclair.
Sala was one of the former fraternity members charged in November in the second round of filings in 2017 after the discovery of a basement tape related to the case.
The preliminary hearings for the brothers are scheduled to start in August.
