Death penalty not sought in killing at car wash

EBENSBURG, Pa. -

A Johnstown man charged in the stabbing death of his girlfriend at a Moxham car wash last summer will not face the death penalty if convicted of first-degree murder.

Demetrius Gibson, 21, of Johnstown, is charged in the Aug. 6 stabbing death of 21-year-old Elizabeth Ann Miller.

According to the Tribune-Democrat, prosecutors told a Cambria County judge during Gibson's arraignment Tuesday that they would not seek the death penalty.

State law requires a defendant and his attorney to be notified if prosecutors plan to seek execution.

Defense attorney Thomas Dickey said he will seek a jury trial on charges of criminal homicide, aggravated assault and simple assault.

At a hearing last month, a witness said Gibson and Miller had been fighting the night before the stabbing.
